NOIR ARC operates this website and provides fragrance decants and related products for sale. Throughout the site, the terms "we," "us," and "our" refer to NOIR ARC. By visiting our site and/or purchasing something from us, you engage in our Services and agree to these Terms, including any additional policies referenced herein.

2. Eligibility

We strive to provide accurate descriptions and images of our products. However, we do not guarantee that product descriptions, images, pricing, or other content on our website are completely accurate, current, or error-free. All products are subject to availability, and we reserve the right to discontinue any product at any time without notice.

4. Authenticity and Independent Retailer Disclaimer
NOIR ARC only sells 100% authentic fragrances and fragrance decants. Fragrance decants are transferred from authentic retail bottles into smaller containers by NOIR ARC. We are not authorized retailers of the brands we carry and operate as an independent reseller. We are not affiliated with, endorsed by, or sponsored by any fragrance brand unless explicitly stated. All third-party brand names, trademarks, and product names referenced on this website are the property of their respective owners. Their use is for descriptive purposes only and does not imply affiliation or endorsement.

5. Pricing and Payments
All prices are listed in U.S. Dollars (USD). We reserve the right to modify pricing at any time without prior notice. By placing an order, you agree to provide current, complete, and accurate billing and payment information.

6. Order Acceptance and Cancellation
We reserve the right to refuse, limit, or cancel any order for any reason, including but not limited to:

  • Suspected fraud or unauthorized activity
  • Errors in pricing or product information
  • Product availability issues
  • Violation of these Terms

Orders may be canceled by the customer within 1 hour of purchase if they have not yet been processed or shipped.

7. Shipping
Shipping times are estimates and are not guaranteed. NOIR ARC is not responsible for delays caused by carriers, weather conditions, customs processing, or circumstances outside of our control. Risk of loss and title for products pass to the customer upon delivery to the shipping carrier.

8. Returns and Refunds
All sales are final unless otherwise stated in our Refund & Return Policy. If an order arrives damaged, defective, or incorrect, customers must contact us within 72 hours of delivery at noirarcdecants@gmail.com and provide supporting photos. Approved claims may be eligible for a refund or replacement at our sole discretion. Please refer to our full Refund & Return Policy for complete details.

9. Product Warranty Disclaimer
Products are sold as-is. NOIR ARC makes no warranties, express or implied, regarding fragrance performance, longevity, or suitability for any particular purpose. Fragrance performance varies by individual skin chemistry, environment, and storage conditions and is outside of our control.

10. Intellectual Property
All content on this website, including logos, graphics, images, text, designs, and branding, is the property of NOIR ARC and may not be copied, reproduced, distributed, or used without our prior written permission. All third-party brand names, trademarks, and product names referenced on this website remain the property of their respective owners and are used for descriptive purposes only.

Our maximum liability for any claim relating to a purchase shall not exceed the amount paid for the product giving rise to the claim.
